K. Hatzidakis: The new Labor Inspectorate will contribute to the fight against ‘black’ and undeclared work

“The new independent Labor Inspection Authority in combination with the digital work card will put in order and will contribute to the treatment of” black “and mainly suggested work” stressed the Minister of Labor and Social Affairs Kostis Hatzidakis, during the presentation to the Institutions and Transparency Committee proposed members of the Board of Directors of the Labor Inspectorate.

“With the transformation of the Labor Inspectorate into an independent Authority, into the successful model of ADAE”, underlined the Minister of Labor and Social Affairs, “we strengthen the protection of workers” and from a service of the Ministry of Labor under the orders of the Minister and the Secretary General – as it has been for decades – it is transformed into an Independent Authority, with greater guarantees of credibility in the eyes of third parties, which will carry out its audit work more effectively “.

The members of the Board of Directors of the Labor Committee emerged from a Tender announcement under the president of ASEP, who selected the ten most dominant candidates and then the Minister of Labor selected the five candidates. In the immediate future, the announcement of the Competition for the selection of the commander of the Labor Inspectorate will follow, with a similar procedure. The commander with his decision will issue the Organization of the Labor Inspectorate, which will describe the structure of the services of the Authority, their responsibilities and the Internal Rules of Operation. Immediately after, the Minister of Labor will issue a Certificate of Act for the commencement of the operation of the Labor Inspectorate, which will be the universal successor of SEPE, which until then operates normally.

The MPs of ND expressed a positive opinion to the elected Messrs. Mina Analytis, Theodoros Lytras, Aphrodite Makrygianni, Georgios Pelekanakis and Maria Sikalopoulou, for their appointment as members of the Board of Directors of the Labor Inspectorate. Clarifying that the negative vote does not concern the persons but the political choice of the establishment of the Authority, SYRIZA, KKE, Hellenic Solution and Mera25 voted against25. KINAL was “present”.

The Undersecretary of Labor, in charge of social security, Panagiotis Tsakloglou, stated that these five members emerged from the “open” procedure provided by law and with evaluation procedures. The proposed list included 10 candidates who all had very good CVs.

Responding to MPs’ remarks, he said that “the overall experience we have from the operation of the Independent Authorities in Greece, I think is undoubtedly positive.” He pointed out that “the transformation of SEPE into an Independent Authority is done with the aim of strengthening, independence and depoliticization of the Labor Inspectorate. .

Regarding the staffing of the Authority, he stated that already through the institution of transportation 100 people have gone to SEPE and we want its human resources to be as high as possible, we are also determined to support it in the field of logistics infrastructure. Of course, always, depending on the resources available each time.

His rapporteur SYRIZA Mariliza Xenogiannakopoulou stated that the main opposition party had voted against the law for the establishment of the Independent Authority, as it was a continuation of the discrediting of SEPE that the government started after the elections. We believe, he said, that unfortunately, in this way the control for health and safety and for the labor relations, which have mainly been affected by the complete deregulation brought by the Hatzidakis law, will not be strengthened. We consider the comparison with AADE unlucky, as AADE is basically a collection authority, while SEPE has a completely different tradition and operation and mission. We will vote against, not for the persons of the candidates who are at all remarkable, but for reasons of principle and consistency with our attitude and our commitment for the abolition of law 4808. He attributed, however, a long delay in the formation of the Authority, as the law has voted for 7 months. This creates a multi-month transition in a period of deregulation of labor relations. He also noted that in at least four cases the Commission’s score crisis was overcome.

His MP ΚΙΝΑΛ Vassilis Kegeroglou stated that from the beginning we are in favor of independent authorities, when of course it is a matter of balancing the power of the central government and not when it comes to the dismissal of responsibilities of the hard core of the state and the central government, as was done with the institutional framework SEPE. He noted that there are Independent Authorities that have been set up administratively but have not actually secured this role. He asked to be informed about the selection criteria, but also the incompatibilities regarding the activity of the candidates. Among other things, he noted that with the new restructuring, the trilateral that existed and offered substantially, are abolished. The reconciliation process goes to OMED. The termination of the Labor Inspectorate by the Ministry of Labor constitutes a direct violation of the provisions of International Labor Convention 81 and 150.

His MP KKE Christos Katsotis claimed that the Independent Authorities follow a class policy, as they operate and implement the laws passed by the political parties. There is, he said, no connection between employee and employer. He estimated that this Authority will be an employer mechanism. He said that today labor inspectors spend 50% of their time on administrative work and do not go out to do inspections. We, he said, believe that the movement can impose another Labor Inspectorate and another Labor Law and can clash with all this logic that exists in companies, which says: “cheaper and cheaper labor to earn more” . This logic wants a reversal, he noted.

Her MP Hellenic Solution Antonis Mylonakis, stated that no Authority is independent, but they are all dependent on the respective government, which selects the persons and places them. Today we have with it 33 to 43 Independent Authorities of which 5 are the constitutional ones. Governments, he said, have been trying since the 1990s to turn the Labor Inspectorate into an Independent Authority, but have found EU law against them. The inadequacy of the mandated organs and services of the state can not lead us to recommendations of Independent Authorities. That is why the Greek Solution is the one against the Independent Authorities and we say that we should give strength and power to the civil servants to be able to carry out their work.

His MP DAY25 Sofia Sakorafa accused the leadership of the Ministry of Labor that it almost never corresponds to the daily reality of work in Greece. The Greek State seems to be completely compatible with the ineffectiveness of the controls and I would not like to say that maybe something is supporting it. Even when individual inspections of the Inspectorate are carried out, they seem to have some compliance results, they are so weak, that they hardly affect the general uniform state of work in our country and the environment becomes more and more gloomy. The word work, the sacred right to work of man, has ceased to exist in our vocabulary. It is, therefore, an integral part of government policy to turn a blind eye to these phenomena and to employers, thus giving it the green light for the corresponding arbitrariness.
