K. Tsiaras: Justice can not be in the tug of war of the minority controversy

“We are promoting a specific plan of reforms in the judiciary that aims to provide solutions to pathogenesis, to modernize it with the social reality and to fully restore the trust that the citizens must have in it”, stressed the Minister of Justice Konstantinos Tsiaras, speaking in the draft law on ” Transposition of Directive (EU) 2019/713 of the European Parliament and of the Council of 17 April 2019 on the fight against fraud and counterfeiting of non-cash means of payment and the replacement of Council Framework Decision 2001/413 / JHA (L 123) and other urgent provisions “.

The minister pointed out that he is convinced that justice can not be in the tug of war of micro-political controversy for reasons that one can always come up with just to oppose. Recorded pathogens in the field of justice can not be an argument against any step taken to improve a problem. This, said Mr. Tsiaras, is a critique of rejection of any proposal that may aim to address all of these issues that we know and all recognize.

The discussion, the minister said, today focused on the issue of speeding up the administration of justice regarding the postponements of the trials, but what has been proven is that except for us, (ie the SW) no one else wants to put their finger on the types of nails.

Regarding the incorporation of the Directive, and the criticism leveled by the opposition parties, Mr. Tsiaras remarked that he seems not to be interested in the fact that there is a letter from the EU that gives us directions on how this Directive should be incorporated in the our national law. That, he said, I can not understand except the KKE, which from the beginning rejects anything that comes from the EU.

The minister also expressed surprise at the criticism of “revenge pornography” exercised by opposition parties and added “you tell us that a provision that for the first time formalizes an offense and is fully in line with the Rule of Law that exists today in the PK “For the amount of the sentences, is it a matter of disagreement? Instead of rushing to apologize to all these victims and say that even a little late the State legislates, your criticism is that we are changing the PK!” instead of applauding it.

On the issue of postponements of his own, Mr. Tsiaras, pointed out that previous governments have tried to limit this issue. The issue, however, is, Mr. Tsiaras observed, that we all want to be ostriches rather than see the problem in detail. Multiple postponements are a phenomenon that we all know and recognize and we should deal with it and not leave it unregulated. And what we do is the obvious. Lawyers should not be able to get beyond one postponement for reasons of another obligation in a trial. Lawyers may not want that – and I understand it – but we are here to defend the right of the Greek citizen. As, in addition to the accused who has the right to who will defend him, there is also the victim and the witnesses who are called and suffer by going to and from the courts.

The Minister underlined that the provision of a postponement for the lawyers with the improvement that has proceeded does not change, neither in its essence, nor in its spirit, we just added after a dialogue with the institutions, that there should be a provision in case it later an obstruction arises in an advocate.

The Minister of Justice also referred to the issue of understaffing of the courts that emerged in the discussion and especially the shortages of court officials, saying that I am the first to recognize it and it is timeless. And the problem lies in the ASEP competitions which, in the way they were done, led to the possibility for the successful candidates to be in the courts and not in other public services. The solution, said Mr. Tsiaras, is in the establishment of the new National School of Judicial Officers, which was proposed today as a bill in the Council of Ministers.

The Minister also added another legislative addition to the amendment of the Ministry of Justice regarding the cleaning contracts of the courts of the Attica Region in order to resolve the specific issue that has arisen recently.
