KINAL: Amendment to the draft law of the Ministry of Labor

On the occasion of the recent events regarding the inhumane conditions in a private structure for hosting the elderly in Crete, PASOK – Movement for Change MPs tabled an amendment aimed at activating and intervening the State in the actual control of the operation and administration of similar structures in the country.

AMENDMENT – ADD

In the draft law of the Ministry of Labor and Social Affairs “Modernization of the Electronic National Social Security Agency and other provisions for social security”

Subject: “Appointment of a temporary administrator in Child and Elderly Care Units in cases where the owner or administrator is unable to perform his duties due to charges against him for committing heinous criminal acts, as a result of his pre-trial detention”

Explanatory Memorandum

The proposed amendment addresses a serious social problem caused by the inability to exercise the duties of managers and owners of Retirement Homes, Nursing Homes, Nursing Homes and Child Protection Units, operating in the legal form of Private Private Ν.Π.Ι.Δ.), Limited Liability Companies (Ltd.), Private Capital Companies (PCS), Civil Non-Profit Companies (Α.Μ.Κ.Ε.) or Social Cooperative Enterprises (Koin.S.Ep). The inability to perform the duties of the above persons arises either from charges brought against them for criminal offenses, or from the actual non-performance of their duties. For the smooth continuation of the operation of these Units, especially when hosting the elderly or children, the proposed amendment provides for the appointment for a period of 6 months – with the possibility of extension for another six months – of temporary administrator by the Minister of Labor and Social Affairs.

The following article is added to the draft law of the Ministry of Labor and Social Affairs “Modernization of the Electronic National Social Security Agency and other provisions for social security”:

1. In Retirement Home Units, nursing homes, nursing care units or child protection units owned or managed by Private companies, Legal Entities under Private Law (N.P.I.D.), Limited Liability Companies (Limited Liability Companies), Private Capital Companies (PCS), Civil Non-Profit Companies (CCCs) or Social Cooperative Enterprises (CSCs), and if their managers or owners have been charged with criminally heinous acts, for which they have been referred or remanded in custody, may by decision of the Minister of Labor and Social Affairs appoint a temporary administrator for a period of up to six (6) months and exclusively for the management of the mentioned units. The same decision determines the responsibilities of the interim administrator and the provision to him of all the necessary means to perform his work. The above period of six (6) months may be extended once for the same reasons with the additional condition that the Unit continues to accommodate children or the elderly.

2. A temporary administrator may be appointed a civil servant who serves in the Ministry of Labor and Social Affairs or in a Social Welfare Center or in the relevant Local Government District or in a municipality of the Regional Unit in which the Unit is located.
