Kiss club partners Elissandro Callegaro Spohr and Mauro Londero Hoffmann, Banda Gurizada Fandangueira vocalist, Marcelo de Jesus dos Santos, and music producer Luciano Bonilha Leão, were sentenced this Friday (10), in the judgment of the tragedy which took place on January 27, 2013, in Santa Maria, Rio Grande do Sul.

The convictions would be valid from its announcement, however, a preventive habeas corpus granted by the Court of Justice of Rio Grande do Sul (TJRS) to one of the defendants prevents the immediate fulfillment of the sentences.
“I stand by my decision entirely. However, I add at the end, in view of the communication of the granting of preventive habeas corpus in favor of the defendants, I suspend the execution of the decision I rendered. And despite habeas corpus to only one of the defendants, the need to extend it to all seems intuitive,” judge Orlando Faccini Neto determined.
The disaster, which killed 242 people and left 636 injured, began on the stage, where the band Gurizada Fandangueira was performing, after a fireworks show. The flames soon spread, causing a lot of toxic smoke. One of the members fired a pyrotechnic device, hitting part of the building’s roof, which caught fire.
The club had only one unobstructed exit door. Firefighters and people tried to open passages by breaking the walls of the house, but the delay in helping turned out to be tragic for the visitors.
Most of the victims ended up dying from inhaling toxic smoke, from the sound insulation of the ceiling, formed by a flammable foam, incompatible with safety standards.
