Three defendants convicted of burning down Kiss nightclub were arrested again after Minister Dias Toffoli, of the Federal Supreme Court (STF), overturned the decision that had annulled the jury.
As of 6:40 pm this Monday (2), the Public Ministry of Rio Grande do Sul (MPRS) confirmed the arrest of three of the four convicted: Elissandro Callegaro Spohr in Porto Alegre, Luciano Augusto Bonilha Lion in Santa Maria, and Marcelo of Jesus of the Saints in Sao Vicente do Sul.
In a note, the lawyers of Mauro Londero Hoffmann the only defendant whose arrest has not yet been confirmed, stated that the decision would be “fully complied with and discussed in the appropriate spheres.”
The Kiss Nightclub jury was annulled by the Court of Justice of Rio Grande do Sul (TJ-RS) in August 2022, after the defense of those convicted pointed out nullities in the process and the trial.
Among the illegalities cited were errors in the selection of jurors, private meetings between the judge and jurors without the presence of the parties and irregularities in the preparation of the judgment questions.
THE CNN tries to contact the defendants’ defense. The tragedy at the Kiss nightclub, which occurred in 2013, in Santa Maria, left 242 people dead and more than 600 injured.
