Another important milestone in the development of SEPE into an Independent Labor Inspection Authority (which is one of the main sections of Law 4808/2021 on Labor Protection) is the approval of the five members, who will form the Board of Directors of the Authority, by the Parliamentary Institutions and Transparency Committee.
They are the professor of the Law School of the University of Athens, Theodoros Lytras, the economist and former General Manager of ELINYAE, Mina Analyti, the economists Aphrodite Makrygiannis and George Pelekanakis and the lawyer at Areio Pagos, Maria Sikaou.
As the Minister of Labor and Social Affairs, Kostis Hatzidakis, noted in his introductory speech to the Commission, “for the Labor Inspectorate, we follow the successful model of AADE, which was established by cross-party consensus in 2016, by the SYRIZA government. SEPE from a service of the Ministry of Labor under the orders of the Minister and the Secretary General – as it was for decades – in an Independent authority, with greater guarantees of credibility in the eyes of third parties that will perform its audit work more effectively. for the Board of Directors are excellent scientists and professionals who complement each other and form a team that can make a fresh start in the Labor Inspectorate, in which we invest a lot. are the basic tools to put black and white work in order let us also strengthen the protection of workers. ”
Following the announcement of the Competition for the selection of the members of the Board of Directors in the fall, an Independent Committee under the chairman of ASEP selected the ten most dominant candidates and then the Minister of Labor and Social Affairs selected the five aforementioned candidates and nominated them. assent of the Institutions and Transparency Committee.
In the immediate future, the announcement of the Competition for the selection of the Commander of the Labor Inspectorate will follow, with a similar procedure.
Then, the Governor with his decision (published in the Official Gazette) issues the Organization of the Labor Inspectorate, which will describe the structure of the services of the Authority, their responsibilities, etc. and the Internal Rules of Operation
After the issuance of the Organization, the Minister of Labor will issue a Certificate of Activity for the commencement of the operation of the Labor Inspectorate. From the beginning of its operation, the Labor Inspectorate becomes the universal successor of SEPE. The process of “transition” is expected to be completed in the first months of 2022.
Until the beginning of the operation of the Labor Inspectorate, its responsibilities are exercised by the SEPE, which continues to carry out intensive checks for the observance of the labor legislation, the rules of hygiene and safety.
In the context of the smooth transition from SEPE to the Labor Inspectorate, a regulation that has been included in the multi-bill of the Ministry of Health (voted tomorrow in the Plenary Session of the Parliament) provides for the establishment of a special department (within SEPE), which will support the Labor Inspectorate. its first year of operation, undertaking the budget of the new authority and the execution of expenditure. At the same time, the training of executives who will deal exclusively with the financial management and the supplies of the Labor Inspectorate is progressing, so that the authority can operate autonomously.
The Labor Inspectorate will have operational independence and administrative and financial independence according to the standards of AADE and the National Transparency Authority. The aim is to carry out its work without political controls and interventions and to upgrade its crucial role in compliance with labor law, by speeding up procedures. More specifically, the Labor Inspectorate will be responsible for monitoring the implementation of labor legislation, including working conditions and conditions, wages, health and safety, the implementation of collective bargaining agreements, insurance coverage of employees etc.
