This Tuesday (10), former president Luiz Inácio Lula da Silva (PT) once again claimed that the press was deceived and reproduced lies during Operation Car Wash. He also said that some characters in the operation, such as former judge Sergio Moro and former prosecutor Deltan Dallagnol, who coordinated Lava Jato, are now “ashamed to walk on the street”.
In response, Deltan said through his adviser that “whoever has to be ashamed to go out on the street is the one who has been convicted of corruption in three instances”.
In an interview with CNN this Wednesday (11), the criminal lawyer and pre-candidate for federal deputy for the PSB-SP, Augusto de Arruda Botelho, said that Operation Car Wash has merits, but committed abuses.
He points out that the Operation “uncovered a corruption scheme, prosecuted, convicted and arrested some people who necessarily needed this response from the State”, in addition to recovering billions of reais.
“On the other hand, to obtain these results, Lava Jato ran over the law, tore up the Constitution and disrespected a series of fundamental rights and guarantees of several defendants,” he added.
For the lawyer, the legacy left by the Operation “is of abuse, disrespect for the law, with the justification that the crime of corruption is serious”.
“It is clear that the crime of corruption is a serious crime that needs to be fought and punished. But there is no crime serious enough to justify breaking the law, and that is what Lava Jato has done at various times,” she said.
Speaking of former President Lula (PT), who, within the scope of the Operation, was convicted by the then federal judge Sergio Moro and detained at the headquarters of the Federal Police Superintendence, in Curitiba (PR) for 580 days, Augusto said that “always there is a doubt about the innocence of the former president”.
But he argues that “the Brazilian Constitution gives this answer.
“What is the current situation of former president Lula? Does he have any final criminal convictions? Not. Does he have any criminal convictions? Not. Does he have a lawsuit against him? Neither,” said the lawyer.
“These are the facts based on what the Brazilian Constitution provides and writes, including a stony clause”, he concluded.
