Lawyer: 6.5 years in prison is enough for Sam Bankman-Fried

Mark Mukasey, lawyer for FTX founder Sam Bankman-Fried (SBF), appealed to the court with a request to impose a sentence for the client in the range of 63 to 78 months in prison.

“An appropriate method of arriving at a fair decision would be to look at the adjusted offense level (subtotal), which is 56, reduced by 30 levels, based on zero damages. This gives a guideline range of 63-78 months,” the case file states.

On November 2, 2023, SBF was found guilty of seven counts of money laundering, fraud and conspiracy. He faces a maximum penalty of 115 years in prison. Sentencing is scheduled for March 28.

The lawyer called the proposed life sentence too “grotesque” and objected to the “inflated” $10 billion estimate of financial damages from FTX's bankruptcy.

The defense's appeal also emphasized Bankman-Fried's upbringing, moral character, focus on charity and that his behavior was “never motivated by greed or status.”

“The sentence will deprive Sam of the opportunity to lead a meaningful life and help those most in need in society for decades,” the lawyer said.

SBF has been incarcerated in Brooklyn Jail for almost four months. According to the WSJ, he shared a cell with former Honduran President Juan Hernandez and gave advice to guards about investing in cryptocurrency.

In December, blogger Tiffany Fong interviewed former mobster Gene Borrello, who sat with Bankman-Fried. He said SBF was initially “out of its element” and was targeted for attacks due to its timid nature and “80-year-old body.”
