Lewandowski bans government from using Dial 100 channel for vaccine complaints

Minister Ricardo Lewandowski, of the Federal Supreme Court (STF), determined, this Monday (14), that the Ministry of Women, Family and Human Rights does not make Dial 100 available for the service of people who are against the mandatory vaccination. against Covid-19.

The minister also determined that the portfolio headed by Damares Alves and the Ministry of Health make clear, through technical notes, the understanding signed by the Federal Supreme Court that it is possible to establish restrictive measures for those who decide not to be vaccinated against the disease. Covid-19.

Lewandowski cited a decision by the STF itself in the midst of the Covid-19 pandemic, according to which: “Compulsory vaccination does not mean forced vaccination, as it always requires the consent of the user, although it can be implemented through indirect measures, the which include, among others, the restriction to the exercise of certain activities or the frequency of certain places, provided that they are provided for by law, or arising therefrom”.

Lewandowski’s determination came after a request submitted by Rede Sustentabilidade last week. The party questioned a technical note in which the ministry opposed the vaccination passport and the mandatory vaccination of children against Covid-19.

In this Monday’s decision (14), the minister said that it is up to the federal government to make vaccines against the coronavirus available and encourage the immunization of the population, and not to adopt measures that may serve to discourage people from vaccinating.

“I think it is up to the Federal Government, in addition to making immunizations available and encouraging mass vaccination, to avoid the adoption of acts, without technical-scientific basis or inconsistent with the national legal system, that have the power to discourage the vaccination of adults and children. against Covid-19, especially because Brazil still has an epidemiological situation far from what could be considered comfortable, including due to the emergence of new variants of the virus”, he said.

In the technical note from the federal government, released at the end of January, the ministry said it was not against vaccination campaigns, but against measures that impose mandatory immunization and possible violations of fundamental rights.
