Minister Ricardo Lewandowski, of the Federal Supreme Court (STF), determined this Wednesday (2) the suspension of the action against former president Luiz Inácio Lula da Silva (PT) involving the purchase of Gripen fighter planes, from a company swedish
Lewandowski responded to a request made by Lula’s defense.
According to the minister, there is “plausibility of the allegations referring to the commission of commissive and omissive acts, tainted by the vices of suspicion and incompetence, on the part of the Attorneys of the Republic appointed by the defense”, which, according to Lewandowski, has already been recognized in other cases. processes in the STF.
“It is not possible to ignore, therefore, that the Federal Prosecutors responsible for the complaint regarding the purchase of the Swedish fighter jets acted in concert with the members of the “Lava Jato” of Curitiba, through the Telegram application, to plot, as it seems, artifically, the accusation against the claimant, it is worth remembering that investigations of the same nature, related to the cases “Triplex do Guarujá” and “Sítio de Atibaia”, were considered unusable by the Federal Supreme Court, due to an affront, among others, to constitutional principles of due process of law, full defense and adversarial proceedings”, said the minister in the decision.
Lula is accused of having committed alleged influence peddling in exchange for money for the purchase, by the Brazilian government, of 36 fighter jets from a Swedish company. At the time, he was no longer President of the Republic.
According to the Public Ministry, he would have indicated that he could influence then-President Dilma Rousseff to buy the planes from the Swedish company SAAB, and not those from the French company Dassault.
