The Federal Supreme Court (STF) started, this Friday (11), the judgment of action against the ordinance of the Ministry of Education (MEC) that prohibited the requirement of proof of vaccination against Covid-19 in universities and federal institutes.
The case’s rapporteur, Minister Ricardo Lewandowski spoke out against the MEC’s order, arguing in favor of the autonomy of federal educational institutions and their authority to demand the document.
“The prediction of university autonomy reveals the impossibility of exercising guardianship or undue interference in the very core of its functions, assuring the university the discretion to dispose or propose (legislatively) on its administrative structure and functioning”, highlights Lewandowski in his decision.
The minister also states that the “provision of mandatory vaccination, excluding the imposition of forced vaccination, appears to be legitimate” for the exercise of certain rights.
On December 29, 2021, the MEC published the order prohibiting the requirement, but the act was suspended by Lewandowski himself two days later. In the decision, the minister stressed that health is a duty of the State.
The virtual trial, now with the participation of all the ministers of the Supreme, began at midnight this Friday and runs until 11:59 pm on February 18.
