“Lifetime Review”: with Moraes, STF forms majority in favor of INSS retirees

Minister Alexandre de Moraes, of the Federal Supreme Court (STF), cast a favorable vote in the judgment on the thesis of the “life review” of retirees by the INSS.

The federal government estimates a deficit of R$ 46 billion with a review of benefits.

The analysis of the case began in June last year, but was suspended due to Moraes’ request for inspection, who asked for more time to study the subject.

Moraes’ vote was decisive to establish or not the Review of Life thesis, since the judgment was tied by 5 to 5.

The proposal in question intends to include monthly contributions prior to July 1994 in the calculation of INSS retiree benefits, in accordance with the provisions of Law No. 9,876/99.

The lawyer specialized in labor and social security law Cristiane Grano Haik explained to CNNstill at the beginning of the trial, that, for those who were affiliated to the system before the 1999 law, the average would be when the real currency came into force.

“Let’s assume that the person has contributed since 1980: everything from 1980 to 1994 is not included in this calculation of their retirement, as if they had not contributed”, he said.

The trial resumed at 0:00 am this Friday (25), with the vote of Minister Alexandre de Moraes already registered in the virtual plenary.
