The president of the Chamber of Deputies, Arthur Lira (PP-AL), accepted this Tuesday (14) an appeal presented by deputies Felipe Francischini (União Brasil-PR) and Captain Alberto Neto (PL-AM), and annulled a vote in a House commission that had defined the summons of the Minister of Justice, Anderson Torres.
Even so, via Twitter, after being invited to appear in the Chamber by another collegiate of the House this Tuesday (14), Torres said that he will speak before federal deputies this Wednesday (15).
Francischini and Neto appealed the June 1 decision of the Commission on Human Rights and Minorities, which had approved the minister’s summons, claiming that the board of directors had not responded to requests for more deputies to speak before the result of the vote was announced. . During the session, the president of the collegiate, Orlando Silva (PCdoB-SP), denied that he had injured the internal regiment.
After technical analysis, Arthur Lira decided to cancel the vote held, which had ended in 10 to 7 by the summons of the minister. “It is noteworthy that it would be necessary for only two deputies to change their votes for the result to be reversed. […] it must be admitted, as a matter of principle, that the use of the floor by deputies has the potential to influence deliberations. Otherwise, parliamentary debates would be innocuous”, says the decision.
The main issue to be discussed with the minister would be the conduct of federal highway police officers in the case of Genivaldo dos Santos, killed during an action in Sergipe. Genivaldo died on May 25 after being arrested in the trunk of a PRF vehicle with tear gas, during an action by federal highway police in Umbaúba (SE). According to a report from the Legal Medical Institute (IML), the death was due to asphyxia and respiratory failure.
In the case of a summons, the person called is obliged to attend. The Chamber’s bylaws provide that absence without adequate justification for a summons implies a crime of responsibility. Thus, without the summons, Justice Minister Anderson Torres is no longer obliged to attend the public hearing scheduled for this Wednesday (15).
This Tuesday, the Committee on Work, Administration and Public Service of the Chamber approved two invitations for Torres to also speak about the Genivaldo case. Thus, the minister agreed to appear in the Chamber this Wednesday (15). The hearing is scheduled for 3 pm and will be joint, with deputies from the Commission on Human Rights and Minorities and from the Commission on Work, Administration and Public Services. “Arthur (Lira) himself made himself available, made contact with the minister, and the Minister of Justice said he would come. Even though the summons by Arthur Lira is cancelled, he will come and participate in a public hearing”, said Orlando Silva.
The report spoke with interlocutors of Minister Anderson Torres who confirmed that he was instructed to attend, even without being obliged “to show that the portfolio is open to dialogue and explanation of whatever it may be”.
