The assessment made by Lira, according to allied congressmen, is that the proposal should not be successful, and that he was not consulted on the matter, but that, as head of the Chamber of Deputies, it is not up to him to prevent a congressman from submit a proposal.

The proposal is authored by federal deputy Domingos Sávio (PL-MG). in conversation with the CNN the parliamentarian informed that he has been collecting signatures to present it “as soon as possible”.
The initiative has the support of government leadership in the Chamber of Deputies. The idea of the proposal, anticipated by the newspaper “O Estado de S. Paulo” and whose outline was obtained by CNN is to include in the Federal Constitution an item that provides for the annulment of decisions of the Supreme Court.
For this, the text predicts, the decision must have “been final and unapproved without the unanimous approval of its members” and provided that it “extraces the constitutional limits”. The annulment would be “effective immediately”.
The congressman called the initiative the “PEC of Balance between Powers” and explained that, if approved, it would not be simple to process a request for annulment of a Supreme Court decision.
In addition to the prerequisites provided for in the proposal, in order for it to begin processing, it would need to obtain the support of an absolute majority in the House and Senate. If the annulment request obtains the necessary support, it would only be approved with the support of 3/5 of the House and Senate, in two voting rounds.
“I am completing the signature collection. Today it is evident that we live in an environment where the lack of balance between the powers becomes clearer every day. The Federal Constitution provides for harmony and independence, but in practice it is evident that this is not happening,” he said.
For the PEC to be presented, at least 171 signatures are required in the Chamber of Deputies. The parliamentarian stressed that he defends the independence of the Judiciary and that the objective of the initiative is, in his view, to improve the system of “checks and balances”.
“Under no circumstances do I want to take powers away from the STF. I vigorously defend the independence of the STF. When I present such a proposal, I am valuing the Supreme Court,” she pointed out.
