The defense of police chief Rivaldo Barbosa, investigated for planning the murder of Marielle Franco and Anderson Gomes, asked the Federal Supreme Court (STF) to relax the precautionary measures imposed on the former Rio de Janeiro police chief and his wife, Érika Andrade by Almeida Araújo.
Lawyers Marcelo Ferreira de Souza and Felipe Dalleprane Freire de Mendonça, who took on the couple's defense last week, are asking Minister Alexandre de Moraes to unblock the delegate's two salary accounts and adjust the nighttime home curfew hours imposed on the wife. .
Érika Andrade de Almeida Araújo was the target of search and seizure in the operation that arrested Rivaldo and is accused of using companies to launder money from crimes allegedly committed by the police chief. She is also being investigated for criminal organization and passive corruption.
The lawyers want Moraes to unblock two of the police chief's salary accounts so that the money can financially support his family. “It happened that the blockade reached the amounts received as the salary of the investigated Rivaldo, necessary for the subsistence of his family, even though there was no decision to suspend his remuneration”, state the lawyers.
“It is worth noting that the intention here is not to release other goods or financial assets that may be blocked, but simply to provide funds of a food nature capable of maintaining the existential minimum of the family nucleus of those being investigated, in honor of the principles of the presumption of innocence and the dignity of the human person”, argue criminalists.
The couple's defense also argues that the decision that established home confinement at night does not provide for a time limit for her to go home every day. According to the lawyers, when the electronic ankle monitor was installed by the State Secretariat for Penitentiary Administration in Rio, it was decided that 10pm would be the cut-off time.
“It turns out, however, that the investigated Érika needs to pick up her daughter from college at 10pm, and cannot count on the help of her father (the investigated Rivaldo), who remains in prison due to the facts under investigation”, state the lawyers.
The defense also maintains that Érika and her children are experiencing moments of insecurity, due to hate speech that is increasing as a result of the news that is being published daily in the press.
Minister Alexandre de Moraes must request a statement from Attorney General Paulo Gonet before making a decision. There is no deadline for this.
