McDonald’s stops selling McPicanha in Brazil after snack ban in DF

McDonald’s announced that it will withdraw from circulation in the country, starting this Friday (29), all sandwiches from the “Novos McPicanha” line. The decision comes after the ban, by the Federal District Procon, which vetoed the commercialization of the snack because it does not contain real picanha.

In a note, the fastfood chain states that the name chosen was intended to “provide a new experience to the consumer with the exclusive picanha-flavored sauce, a new presentation and a different hamburger in composition and size”.

The meat would be made up of a “blend of selected cuts”, according to McDonald’s, but without the picanha cut. This resulted, for Procon, in the practice of misleading advertising on the part of the company.

“In the advertising there is no clear information that the hamburger contains any percentage of the beef sirloin cut. So, the way McDonald’s uses the name “picanha” in its product and in the advertising campaign for the sandwich leads to the understanding of a product composed of the cut of picanha meat”, said the director general of Procon do DF, Marcelo Nascimento , in note.

“This misleads the consumer and is characterized as misleading advertising”, he concluded. The ban on the sale of snacks in the Federal District went into effect on Thursday (28).

According to the Consumer Protection Code, misleading advertising occurs when there is “any type of information or communication of an advertising nature, wholly or partially false, or in any other way, even by omission” that may mislead a person in relation to to the product’s characteristics.

In the positioning, McDonald’s still apologizes “if the name chosen raised doubts” and states that it is “evaluating the next steps”.
