The Ministry of Education (MEC) and the Comptroller General of the Union (CGU) sent, this Monday (11), clarifications to the Federal Supreme Court, with explanations about the criteria adopted to guide the transfer of resources from the National Fund for the Development of Education (FNDE).
FNDE transfers to mayors came under investigation after mayors reported requests for bribes made by pastors who would have privileged access to the MEC. The case was revealed by the newspapers “O Estado de S.Paulo” and “Folha de S.Paulo”.
In the technical note sent to the STF, the president of the FNDE, Marcelo Lopes da Ponte, stated that the transfers “occur in accordance with the criteria established in the legislation that governs each transfer”.
“In view of the broad reasoning above, the FNDE forwards this Technical Note with the aim of clarifying to the Federal Supreme Court (STF), the schedule for releasing funds by the National Development Fund in 2021, it is worth noting that in all In these cases, transfers take place in accordance with the criteria established in the legislation that governs each transfer”, said Ponte.
Ciro Nogueira’s former chief of staff when the current Civil House minister was in the Federal Senate, Ponte was appointed to the FNDE in June 2020.
The Federal Comptroller General’s document says that “the flow of funds release, as well as the criteria adopted, are governed by CD/FNDE Resolutions No. 24/2021 and No. 4/2020. In summary, the transfer of public resources to the FNDE to States and Municipalities occurs significantly through the Plan of Articulated Actions”.
“Notwithstanding the clarifications provided, it is understood, to the best of our knowledge, that the primary manager of the policy, that is, the National Education Development Fund, is the most qualified actor to present the necessary manifestation to the STF, considering the particularities and criticalities related, as well as for being the normative legislator on the subject”, affirmed the CGU.
The documents respond to a determination by Minister Cármen Lúcia, rapporteur of the investigation against former Minister of Education Milton Ribeiro in the Federal Supreme Court.
When she responded to the request of the Attorney General’s Office (PGR) to open the investigation, the minister determined that the MEC and the Office of the Comptroller General (CGU) clarify the schedule for releasing funds from the ministry and the criteria adopted.
