Minister André Mendonça, of the Federal Supreme Court (STF), denied an injunction submitted by Deputy Nereu Crispim (PSD-RS), president of the Parliamentary Front in Defense of the Autonomous Truck Driver, for the suspension of the processing of the PEC of Benefits in the Chamber of Deputies. .
The president of the Chamber of Deputies, Arthur Lira (PP-AL), decided to postpone the vote on the Benefits PEC due to lack of quorum in the House plenary. The next session is scheduled for Tuesday (12), at 1:55 pm.
In the document, the congressman says that the most serious thing is that the “budgetary” PEC, despite presenting “limit” figures for the amount authorized for expenditure, does not show the impact statement, not even indicating the source of funding.
“By intending to make available the treasury and the budget, in a clear character of social retrogression to the precepts of transparency, social control and participation of the people and control bodies in the inspection and monitoring of public affairs, above all, modifying the Federal Constitution that supports and maintains a symmetrical relationship with all Federated Entities, and therefore the PEC is materially unconstitutional for trying to abolish the Republic itself and the Democratic Rule of Law, and the initiative of the coercive authority to allow the PEC to proceed was a reckless attempt”, he says.
For Mendonça, no minimum requirements were presented to grant the injunction requested by the parliamentarian. For the minister, this type of writ of mandamus to interfere in the processing of a proposal must be something exceptional, only in cases where there is disrespect for the due legislative process, so as not to interfere with the principle of separation of powers.
“In fact, one cannot take for granted or even trivialize the anticipated integral and complete scrutiny of the normative act, still in the political and democratic construction phase within the Legislative Power, under penalty of freezing the legislative function, constitutionally attributed, primarily, to to the Legislature”, he claimed.
The Benefits PEC provides for the recognition of the state of emergency in 2022 and a package of BRL 41.25 billion in aid outside the spending ceiling three months before the elections.
The text creates an aid of R$ 1,000 for truck drivers and an as yet undefined amount for taxi drivers, in addition to expanding Auxílio Brasil to at least R$ 600 per month and the gas voucher to around R$ 120 each two months, among other points. These measures would be valid until December 31 of this year.
