Minister André Mendonça, of the Federal Supreme Court (STF), gave Petrobras five days to provide “meticulous information” regarding the criteria adopted for the pricing policy established in the last 60 months.
The minister stated in the decision that Petrobras, as a mixed capital company of the Union and a member of the Indirect Public Administration, must pay attention to the Constitution and laws that govern its activity, which includes the principles of transparency; the conciliation between free enterprise and the social function of property and consumer protection; as well as to meet the imperatives of national security, the relevant collective interest and its social function.
The minister also asked the ANP and CADE to provide information regarding the measures adopted, within their legal competences, in relation to the pricing policy practiced and the company’s performance.
Mendonça also suspended the effectiveness of the ICMS 16/2022 agreement of the National Council for Finance Policy (Confaz) and decided that the ICMS fuel rates must be uniform throughout the national territory. The minister also stipulated a series of measures that must be observed by the states and by Petrobras.
The decision comes on the same day that the state-owned company announced a new adjustment in fuel prices. Starting tomorrow, gasoline will rise in refineries from R$3.86 to R$4.06 per liter, an increase of 5.18%. With diesel, the price per liter will rise from R$ 4.91 to R$ 5.61, which is equivalent to a 14.26% readjustment.
