Mendonça gives the government and Congress 24 hours to express their views on the states’ proposal for ICMS

Minister André Mendonça, of the Federal Supreme Court (STF), gave a period of 24 hours for the government and Congress to express their views on the states’ proposal for the calculation of ICMS (Tax on the Circulation of Goods and Services).

In an order on the afternoon of this Monday (13), the minister says that, after the deadline, “with or without manifestation” from the Executive and the Legislative, he will examine possible approval of the agreement.

This Monday, the states presented to the Supreme a proposal on the calculation of the tax that is levied on fuel, collective transport, electricity and telecommunications. The Comsefaz proposal involves the reduction, by the end of 2022, of the calculation base in these sectors, so that the effective tax burden corresponds to the application of the modal rate of each State.

In addition, the finance secretaries suggest the full compensation of the tax losses of the states with these new rules, through the transfer of resources from the Union or by reducing the debt of the federative entities with the federal government. This compensation will be carried out from a 5% trigger on the drop in collection.
