The former first lady of Tamandaré (PE) Sari Mariana Gaspar Corte Real, convicted of the death of Miguel Otávio Santana da Silva, the 5-year-old boy who fell from the 9th floor of a building in Recife in 2020, is suing the actress and influencer Luana Piovani for moral damages.
In the action, which has been pending at the Pernambuco Court of Justice (TJ-PE) since November 2024, Sari alleges that Luana Piovani made statements that violated her “honor and dignity” in videos published on social media. In court, the former first lady demands compensation of R$50,000. The information was confirmed to CNN .
The case, which gained national attention, involves the death of Miguel, a 5-year-old boy, who fell from the 9th floor of a building in Recife in 2020, while he was under the responsibility of Sari Corte Real.
At the time, Mirtes, Miguel’s mother and domestic worker for the Corte Real family, who was working during the pandemic, had left her son in Sari’s care while she walked the former first lady’s dog. In court, Sari was held responsible for leaving the child alone in the elevator and pressing the button that took Miguel to the 9th floor, where the tragedy occurred.
The action against Luana Piovani arose after the influencer commented on the decision of the Superior Court of Justice (STJ) that suspended the conviction of Sari and her husband, Sérgio Hacker, to pay compensation of R$1 million to Miguel’s family. Sari’s defense alleges that Piovani, at the time, called her a “criminal” and “murderer” and made other attacks on her honor, in addition to stating that Sari should be in jail.
THE CNN Sari Corte Real’s lawyer, Danilo Heber de Oliveira Gomes, explained that the procedure seeks not only compensation, but also a pedagogical effect.
“In the action, we consider that this is not a limitation on freedom of expression, as everyone has the right to speak out, especially in widely known cases like this. However, social networks have rules and, when someone accuses crimes or hurts another person’s honor and image, that person needs to take responsibility.”
“Furthermore, it is important to highlight that Luana Piovani’s profile is not that of an ordinary person, with a thousand or two thousand people, but millions of followers – if I’m not mistaken, around five million. Therefore, every comment she makes has a huge impact”, added the lawyer.
Judge Ana Claudia Brandão de Barros Correia, from the 29th Civil Court of the Capital, has already summoned the actress to speak out in the process.
In response to CNN Luana Piovani commented on the case. “There’s not much to say. Does a convict feel offended because I called her privileged? And the Brazilian justice system is embarrassed while the pseudo-doctor plays at being happy. And Mirtes, my God? Is anyone thinking about her?” asks the artist.
