Miguel case: Justice denies third habeas corpus to mayor of Tamandaré (PE)

The Federal Court in Pernambuco denied, this Tuesday (20), another habeas corpus to Sérgio Hacker Corte Real, former mayor of the municipality of Tamandaré (PE), who is responding to a criminal action for using public resources to pay domestic workers.

Sérgio Hacker Corte Real is the husband of Sarí Corte Real, she is convicted of abandonment of incapable. In 2020, the son of the couple’s maid, 5-year-old Miguel Otávio Santana, was in his care when he died when he fell from a building in Recife.

Unanimously, the Second Panel of the Federal Regional Court of the 5th Region – TRF5 rejected the request filed by the defense of the former mayor.

“With the decision, the former manager will continue to respond to the criminal action in which he is accused of having used public resources to pay three domestic workers, who held commissioned positions in the City Hall, but provided services to his family, between 2017 and 2020” , said the TRF5.

This is the third habeas corpus presented by the defense of Sérgio Hacker in relation to the same criminal action.

“In the two previous requests, the ex-mayor’s defense protested against the competence of the federal justice system and also against the fact that the Public Prosecutor’s Office had not proposed a non-prosecution agreement,” the Court explained.

Miguel case

The boy Miguel Otávio Santana da Silva, 5, died after falling from the ninth floor of a building known as “Twin Towers”, in the São José neighborhood, in Recife (PE), in 2020.

According to an investigation by the Civil Police, the fall occurred when the boy’s mother, who worked as a maid in one of the apartments, would have come down with her employer’s dog, Sari Côrte, and left Miguel in her care.

Camera footage from the elevator shows Sari leaving the boy after pressing the penthouse button. He presses other buttons, enters and exits several times, looking lost. Finally, he disembarks and goes to an area where there are air conditioning units, from where he fell from a height of about 35 meters.

Miguel was rescued while still alive by a doctor who lived in the building and sent by ambulance to Hospital da Restauração, but he did not survive.
