Minister of Labor confirms to CNN the proposal to end the FGTS anniversary withdrawal

In an interview with CNN this Wednesday (4th), the Minister of Labor, Luiz Marinho, confirmed that the Ministry is considering putting an end to the anniversary withdrawal of the FGTS (Guarantee Fund for Length of Service). According to the minister, the modality was created by the previous government to inject money into the economy and is “absurd”.

“The previous government, in order to put money on the market, created the birthday withdrawal that would be the guarantee for the payroll loan, creating an aggravation. An absurd business that happened in the market and a distortion in the role of the Fund. It is therefore necessary to put it on the rails.”

Marinho pondered that the new government is not one of “the pen”, but of dialogue. Therefore, the proposal to end the anniversary withdrawal, according to the minister, will be submitted to the Guarantee Fund council to then see its viability. “But I am convinced that this is the right path,” he said.

The minister pointed out that the FGTS has a triple function. First, to provide financial security and protection in the event of unemployment, not least because it was created to replace job stability and brought, according to Marinho, the concept of worker savings. Its second function is to finance the worker’s own home and, with that, it achieves its third function of job creation in the housing sector.

Luiz Marinho reinforced that the return of the union tax is “solemnly” discarded. “The union tax has no return. This is ruled out. He was supposed to end up back there.”

According to the minister, unions need to be strengthened, but with a modernization process. “The unions have to be strengthened, without carrying unions that do not represent anyone. It’s a modernization process they have to go through. And we are talking about the employers’ union as well.”

Regarding platform workers, such as transport and delivery applications, the minister stated that regulation is needed, but not necessarily the incorporation of these workers into the CLT contract.

“We need to make a regulation. It is not possible for a worker to have to work 16 hours to bring rice and beans home. This is semi-slave. It is necessary to look at it from the point of view of valuing work, decent remuneration, social coverage. And we are talking about a range of workers, not just motorcycle couriers and deliveries.”

For the minister, it is necessary to find, “in dialogue”, a solution for these workers. “And we are not talking about a rigid rule of the CLT, because even these workers do not want this path of the traditional labor legislation. Even application companies have expressed that they want to dialogue, and together create a basket of possibilities, ”he said.

Marinho recognized, however, that it is a complex issue, but that all possibilities and suggestions will be evaluated. “It’s difficult and complex, but if you sit down and talk, we can build. Spain took a step forward and is a reference in the European Union. Let’s observe this experience and see the projects that are being processed in the Chamber and what else has experience. Let’s put it all together and see what’s best for our workers.”

MEIs

Regarding the 15 million MEIs (Individual Microentrepreneur), Luiz Marinho said that the modality was designed for the social protection of entrepreneurs and that, in the case of employers who “hire” via MEI, they are circumventing the law. “If you have an employer, you are not an MEI. The MEI is an individual option, either by will or a way to access the job market via enterprise. The employer cannot say that the employee will be MEI”.
