A cap on the profit margin for the sale of the appliances (refrigerators, freezers, air conditioners) included in the “Change Device” program is set by the Ministry of Development and Investments with an amendment filed today to the bill of the Ministry of Finance on Excise Taxes.
Under the proposed regulation, the gross profit for these devices may not exceed the corresponding profit per unit before December 31, 2021.
According to the Ministry of Internal Affairs and Communications, the aim of the regulation is to prevent unfair profiteering in the market of products whose purchase is subsidized by the “Switch Device” program, to protect the purchasing power of the consumer, but also to maximize the effectiveness of the subsidy program by ensuring that the the entire benefit of the subsidy will be reaped by the consumer, in order to actually mobilize and purchase electrical appliances with lower energy consumption. The cap will apply until the Switch Device program is complete.
In case of violations, the complaints are submitted to the General Secretariat of Trade of the Ministry of Development and Investments, the Interagency Market Control Unit (D.M.E.A.), and the competent control services of the Regions.
The sanctions provided for start with a recommendation to stop the illegal practice and escalate to a fine of 5,000 to 1,000,000 euros.
The same amendment extends until December 31, 2022 the application of the measure to publicize the trade name of companies that violate the measures to reduce the phenomenon of unfair profit in times of crisis.
