Ministry of Justice plans to inspect posts to check price exposure

The Ministry of Justice plans to carry out an operation as of Monday (11) with the National Consumer Secretariat (Senacom) and the National Petroleum Agency (ANP) to inspect refineries, distributors and gas stations.

The objective is to inspect whether the establishments are complying with the decree of President Jair Bolsonaro (PL) that determines the exposure of prices after the law establishes a ceiling for the ICMS (Tax on the Circulation of Goods and Provision of Services).

This Thursday (7), President Bolsonaro issued a decree that forces stations to display fuel prices before and after the law that imposed a 17% ceiling on ICMS.

The decree was published in this Thursday’s edition of the Official Gazette (DOU). According to the text, gas stations must use as parameters the prices of June 22, the day before the president sanctions the law that sets a ceiling for ICMS rates on fuel.

The assessment at the posts will be made by the Consumer Protection and Defense Foundations (Procons) of each state. The decree does not provide for penalties for posts that do not comply with the government’s determination, but Procon’s inspectors must be based on the Consumer Protection Code.

Section III of article 6 of the CDC deals with the duty of information to be adequate and clear about the different products and services, with correct specification of quantity, characteristics, composition, quality, levied taxes and price, as well as about the risks they present.

In addition CNN found that Senacom should launch this Friday (8) a link on the internet for consumers to help in the inspection of stations that are not complying with the decree.

Through the link, the consumer can indicate the name, the location of the post and attach a photo indicating which establishment is not exposing the price before and after the law that established the ceiling for ICMS.
