Moïse case: Congolese aggressors testify and present their versions

Testimonies collected by the Homicide Police reveal the versions of those involved in the death of Congolese Moïse Kabamgabe. Among the four men identified in the security camera images, three had their preventive detention ordered by the Justice.

The Tropicália kiosk employee, despite having argued with the victim, did not attack the Congolese. THE CNN had access to all the images of the kiosk’s internal circuit and decided to show the excerpts that show the ambush of Moïse. Assaults will not be displayed.

The deponents revealed that at least five people were at the kiosk where Moïse was killed: the employee at the Tropicália kiosk, the cook at the Biruta kiosk, which is next door, the attendant at the Juninho stall, owned by the same owner of the Biruta kiosk, a salesman street vendor and one of the members of the Biruta kiosk.

The arrested assailants told the police that they already knew Moïse. In the Barra da Tijuca region, he had the nickname “Angolan” and had been working at the Biruta kiosk for about three weeks as a freelancer.

The Congolese, according to the deponents, also had work at the Tropicália kiosk.

According to the testimonies, the discussion would have started between the Tropicália employee and Moïse, because the Congolese was drunk and trying to get drinks from the kiosk.

He claims that the establishment did not owe the young man any value and that Moïse threatened him to get beer from the cooler.

Everyone says that the Congolese had been drinking heavily during the last three days and that he was a drug user. The family and the OAB deny and call the claims an attempt to disqualify the victim.

The attackers told the police that they heard the fight and went to defend the Tropicália employee. All claim that there was no racial or xenophobic motivation for the attacks.

Some even said that they were practitioners of Candomblé, a religion of African origin, or that they were black, and therefore, according to them, the attacks were intended to immobilize Moïse.

The employee at Barraca do Juninho, which is close to the kiosks, confirmed that he immobilized the architecture student while the others applied blows.

He said he applied the coup after Moïse faced him, after having ordered the Congolese not to open the cooler at the Tropicália kiosk. According to him, the immobilization lasted about eight minutes. The employee says he “has a clear conscience” because he claims to have only held the victim.

The cook at the Biruta kiosk stated, in testimony, that he decided to attack Moïse because he “had been disturbing him for a few days” and, therefore, “decided to vent the anger he was feeling”.

The cook was the second aggressor to use the wooden baseball bat to hit the Congolese. The club would have been brought by the street vendor, who was the first to hit the victim.

According to the police, the attackers delivered at least 30 blows with the wooden bat, most of them while the Congolese was on the ground, helpless. The victim was still tied with a rope by the deponents.

Those involved only called SAMU when a customer claimed that Moïse was dead. Another couple tried resuscitation maneuvers, as did the man who immobilized the Congolese.

According to reports, the ambulance arrived at 11:15 pm and death would have occurred around 10:25 pm, nearly an hour earlier.
