Montenegro’s highest court overturned a lower court’s decision to release Terraform Labs founder Do Kwon on bail.

Earlier in May, a court allowed the release from custody of Do Kwon and former Terraform CFO Han Chang-Joon, whom the country’s authorities accused of forging documents.

The detainees promised that if they paid a bail of 400 euros, they would not go into hiding until the end of the criminal proceedings, they would regularly respond to subpoenas and would remain available at the address indicated by the lawyer.

The decision was overturned after an appeal by the prosecutor’s office. The court, which originally decided to release the detainees on bail, will now have to make a different decision. Kwon and Han, at least for now, remain incarcerated.

Kwon hid from Interpol for several months before being arrested on March 23 at the airport in the Montenegrin capital. Law enforcement officials say the Korean businessman tried to travel in a rented private jet with a fake passport.

The U.S. and South Korea are facing numerous fraud charges against Do Kwon for his alleged role in the collapse of Terra last spring.
