Moraes gives Americanas an injunction against Bradesco

Minister Alexandre de Moraes, of the Federal Supreme Court (STF), complied with Americanas’ request and suspended the anticipated production of evidence requested by Bradesco and authorized by the Justice of São Paulo.

In the decision, he says: “I grant the requested precautionary measure, suspending the judgment claiming (…) that determined the search and seizure of the contents of the institutional email boxes of the directors, members of the Board of Directors and of the Audit Committee of the Americanas, of the current ones and of those who served in the positions for the last ten years, of the employees of the accounting and finance areas of the current company and in the last ten years, including and especially with the company Microsoft, until the final judgment of this claim.”

In the document, he also says that “due to the imminence of carrying out the determined diligence, I determine the immediate communication to the complained court, which must provide for the immediate fulfillment of the measure, preventing the beginning or continuity of any data extraction, determining the restitution to the claimant Americanas of any material already extracted from the mailboxes, maintaining the secrecy of its content. A copy of this decision will serve as an official letter for immediate compliance. Information is requested from the claimed authority.”

The main argument of the Americanas is that the request reached a series of emails exchanged between lawyers and the company’s legal board, thus violating the lawyers’ professional secrecy.
