Today, the Savelovsky Court of Moscow held a hearing on the case of reclaiming misappropriated bitcoins. After an hour’s hearing, the judge dismissed the claim.
Recall that the lawsuit was filed in the spring of this year. The plaintiff Andrei Petrov accused his friend Igor Tukan of embezzling 16.6 BTC. According to the statement, in 2018, Petrov gave him bitcoins in trust. However, Toucan declared the loss of all assets and refused to return the funds transferred to management to the plaintiff.
At the time of drawing up the claim, the lost BTC was estimated at 45 million rubles. At the current exchange rate, their cost is 78 million rubles. Petrov’s interests in the court are represented by lawyer Boris Bashilov, and the lawsuit was considered by judge O.M. Koroleva.
“The meeting lasted an hour, the judge spent a long time in the deliberation room, but refused,” Bashilov said, adding that the reason for the refusal would be announced later, but he intends to appeal the decision of the Savelovsky court.
On January 1, 2021, the law on digital financial assets came into force in Russia, according to which bitcoins and other cryptocurrencies are recognized as property. However, at the time of the transfer of BTC into trust, there was no such law yet. Perhaps that is why the court decided to dismiss the claim.
