The Public Ministry of São Paulo appealed against the decision that kept Elize Matsunaga free. She responds to an inquiry for using a false document.
The MP had asked in court, last Monday (6), that the confessed murderer of Marcos Matsunaga return to prison for having violated the parole rules.
However, the Criminal Execution Court of the city of Franca took a decision contrary to the first request of the Public Ministry.
In a note, the Court of Justice of São Paulo stated that Elize has fulfilled the conditions imposed on her and that the processing of the process in the Judicial District of Sorocaba is in the initial phase, without conviction.
At the end of last month, the police seized the cell phone and a computer of Elize, who gave her statement. The suspicion is that she would have used a fake criminal background document to get a job.
Currently, she works as an app driver. In a note, the company said that it requires drivers, all over 18 years of age, to have a National Driver’s License, a vehicle in good condition and with up-to-date documents.
“Elize Araújo Giacomini (the maiden name she used again) meets all the requirements and, in addition, has a good evaluation and no complaints on the app”, says the text.
In 2012, Elize Matsunaga killed her husband, then executive director of the Yoki food industry, in the couple’s apartment, in the west zone of São Paulo.
In testimony, she confessed to the crime and said she would have discovered an extramarital relationship with her husband.
Then, during an argument, he shot the businessman. She then quartered the body and left it at various points in the city.
Denounced for triple qualified intentional homicide, destruction and concealment of a corpse, Elize was sentenced to more than 19 years in prison, having served 10.
She left the Tremembé Women’s Penitentiary in 2022, after a court ruling granted her parole.
