The São Paulo Public Prosecutor’s Office asked for the filing of the case of aggression involving two military police officers against an elderly woman and her children, in Igaratá, in the interior of the state, in May.
According to the prosecutor who signs the document to which the CNN had access, Daniel Gruenwald Lepine, there are not enough elements to prove that PMs Kleber Freitas da Silva It is Thiago Alves de Souza attacked Vilma dos Santos Rodrigues de Oliveira since the expert report did not find bodily injury to the elderly woman.
In addition, according to the MP, there is controversy between the elderly woman’s version and the facts exposed in the video recorded at the time of the confusion.
The prosecutor explained that, to the police, Vilma confessed to having “smacked” the military policeman while he was trying to handcuff one of her children. She said that PM Kleber would have gotten up and punched her in the face, then the policeman would have taken the gun from his belt and pointed it at the elderly woman, in addition to threatening the boy who was filming, saying he was going to shoot him.
However, the MP argues that the video footage shows that Vilma assaulted the military police officer, who, in the sequence, “throws a punch without looking at the target and walks away to protect his firearm”, described an excerpt from the MP’s document .
“The sequence of images contradicts Vilma’s version, which added that the military policeman pointed the firearm at her, which did not happen”, wrote the prosecutor.
The MP also highlighted that, in the video recording, the elderly woman tells the military police that “that punch will cost you”, and the policeman told Vilma that she attacked him first.
As for the attacks on the elderly woman’s children, the investigators did not find that the police vehicle was diverted in transit to the Igaratá police station, which contradicts the version that Luciano and Benedito were attacked on the way.
The expert report also did not confirm damage to the police officers’ batons, “and Luciano and Benedito adduced that a club was broken over the head, which did not happen. Therefore, Luciano and Benedito’s versions lack credibility”, reveals the promoter in another excerpt.

The case took place on May 30 of this year. The police were called to an occurrence in Parque das Palmeiras. When they arrived at the scene, they found that a family was arguing with a neighbor over land demarcation.
In the images that went viral, it is possible to see an agent trying to immobilize a man on the ground. When the elderly woman tries to intervene in the approach, another PM punches the woman. At the time, the Secretariat of Public Security (SSP) reported that the police officer involved was removed and that an inquiry was initiated to investigate the case.
In testimony to the Civil Police, the PMs informed that they were attacked by Vilma’s children, Benedito Diogo dos Santos Rodrigues de Oliveira and Luciano Aparecido dos Santos se Oliveira, involved in the confusion. Police officer Kleber would have tried to prevent Luciano from attacking a construction worker who was at the scene, when the man allegedly grabbed him by the face with his nails.
“The policeman said he would handcuff him and take him to the police station. Then, Benedito, Luciano’s brother, approached from behind, applied an injury killer to the military policeman and Luciano started to punch him”, reveals another excerpt from the document.
Based on this, the MP asked that the PMs be heard again by the Civil Police in order to inform whether they wish to make a criminal representation against the children of the alleged victim, for the bodily injuries they suffered.
In a note, the defense of Vilma and the children said that they are not satisfied with the filing request. Lawyers Marcos Soares and Jorge Luiz de Souza also informed that, if Justice accepts the MP’s request, it will take all appropriate measures to reverse this situation.
“In the video, you can clearly see that he looks at my grandmother and hits her with a juice, and my uncles are not hurt as they arrived at the police station later. Light bodily injury was found. But, like, point on the head and everything else, as they were, all misconfigured, that doesn’t make sense. It is obvious that they are trying to “pass the cloth” in this case”, he told CNN Wilma’s grandson, Nelson Pereira de Almeida Junior .
