The Public Ministry of Rio Grande do Sul (MPRS) reported, this Tuesday (24), the mother of the girl Kerollyn Souza Ferreira, nine years old, found dead inside a garbage container in Guaíba, metropolitan region of Porto Alegre (RS), in August of this year.
According to the MPRS, Carla Carolina Abreu Souza, the girl’s mother, was charged with qualified intentional homicide and mistreatment – not only in relation to Kerollyn, but also in relation to her other three children.
The Court received the complaint and, if accepted, it will be judged by the Jury Court.
The children’s father was also charged with material abandonment and may be tried by a jury, since, according to the MPRS, he failed to provide assistance with his daughter’s support.
For Rafael de Lima Riccardi, the prosecutor responsible for the case, Kerollyn’s mother created the risk of her daughter’s death and failed to fulfill her legal duty to protect her. In this way, the prosecutor claims that the child’s death is a direct consequence of the mother’s conduct.
Lima therefore requested the woman’s preventive detention, which was replaced by electronic monitoring. Even so, the MPRS will appeal this decision.
“[Ela] allowed his daughter to roam the streets without any supervision, including in the trash can where she was found, in addition to the fact that, that same night, he administered non-prescription sedative medication with unforeseen consequences to the child, who died in the trash can as a result of mixed mechanical asphyxia, related to the position in the container, the low temperatures and the effect of the medication, according to expert reports”, highlighted Rafael.
Marcelo Tubino, coordinator of the Jury Operational Support Center of the MPRS and public prosecutor, highlighted that the MP understands that this is a case of intentional homicide given that parents have an obligation to care for, supervise and take care of their children.
“The girl had been neglected for a long time. The mother did not keep an eye on her daughter and knew that she was in critical condition that night. Kerollyn had been killed a little bit every day. These defendants did not show the slightest civility towards this daughter. When you are a father, if you are a mother, you make some choices. We need to be better when thinking about our children,” said the coordinator.
What the defense says
Wanted by CNN Carla’s defense says it is not surprised by the accusation filed by the Public Prosecutor’s Office. “The accusations are a maneuver to take the accused to a jury trial, taking advantage of the social commotion and the repercussions given during the investigation,” the defense highlighted.
Furthermore, Kerollyn’s mother’s defense also emphasizes that, at the end of the investigations, it was found that there was not enough evidence to indict Carla for the child’s death.
“Nothing has changed since the indictment. The defense believes in Carla’s innocence and will continue to carry out its work in an ethical and transparent manner, with the certainty that it will demonstrate that this accusation is one of the greatest injustices in the Rio Grande do Sul investigative system,” added Thaís Constantin and Wellyton Noroefé, the defendant’s defense.
Remember the case
The body of Kerollyn Souza Ferreira, 9 years old, was found in a garbage container in Guaíba, metropolitan region of Porto Alegre (RS), on August 9 of this year.
The body was discovered by a recycler, who called the Military Police and the local school. According to the Civil Police, the girl lived in neglected conditions, and it was reported that she often slept in an abandoned car near her home and school.
Delegate Fernando Sodré, responsible for the case, reported that one of the hypotheses suggested is that the death occurred due to medication or drugs, with an excessive dosage, which would be confirmed by the forensic examination.
