The Public Ministry of the State of Roraima (MP-RR) has instituted a procedure to investigate the hiring of a show by the country singer Gusttavo Lima by the São Luiz City Hall, in Roraima, for R$ 800 thousand.
The municipality, located in the south of the state, has a population of 8,232 inhabitants, according to a projection by the Brazilian Institute of Geography and Statistics (IBGE). In the 2010 Census, the population of São Luiz was the smallest among the 15 cities in Roraima.
Considering the 8,232 inhabitants of the municipality, it would be as if each resident of São Luiz had paid R$ 97.18 for a ticket to watch the artist’s performance. The presentation is scheduled for December, at an agribusiness fair.
“The District Attorney’s Office sent a letter to the Municipality of São Luiz requesting information regarding the contracting of the show, how the funds were raised and whether there will be a return to the municipality. The MP-RR awaits the municipality’s response to then adopt the necessary measures”, says a note sent by the Public Ministry.
wanted by CNN the mayor of São Luiz, James Batista, confirmed the hiring and said that “everything is being done respecting what the law 8.666 [conhecida como Lei das Licitações] advocates”.
“We are not breaking the rules and we will be following all the notes that the control bodies make. It is a plan that aims to awaken the potential that the city has, without straying from the zeal with the treasury and the duty to take care of mandatory services”, added Batista.
The mayor added that “it is important to note that we are adjusting the terms of the contract because the payment will be made after the event has taken place”. He also said that “the show will bring us direct income that will allow us to pay all fees and structure, in addition to indirect income”.
“People are frightened by the presence of Gusttavo Lima, but they will certainly be much more astonished when they are in the city and contemplate what we are preparing. The show is not being designed by accident. Soon the whole of Brazil will understand the reasons and whys of the event”, concluded the mayor.
Gusttavo Lima’s advice was sought by the CNN , but has not yet manifested. In a note to the newspaper Folha de S. Paulo, the singer spoke about the case and said that the contracting of the show is within the rules determined by the Law of Bidding. See below:
The artist’s fee is fixed according to internal criteria, based on the national scenario, such as: logistics (air transport, road transport, etc.), type of event (private or public show), as well as the company’s operating costs and expenses for the realization of the artistic show, among other factors.
We do not agree with illegalities committed by representatives of the public power, whether in any sphere.
All contracting of the artist by federal public entities is guided by legality, that is, in accordance with what determines the bidding law.
Regarding the budget for the realization of an “artistic show”, it is up to the federated public entity to act responsibly in its application. It is not up to the artist to inspect public accounts to find out what budget the Chief Executive is using to pay for the contract.
The inspection of public accounts is carried out by Organs TCU (Union Court of Accounts) or TCE (State Court of Accounts), according to their powers, whether at the federal, state or municipal level.
Therefore, any illegality committed by public entities, whether in the contracting of artistic shows or any other form of contracting with the private sector, must be inspected by the Court of Auditors and, if found, any illegality must be forwarded to the competent Court to judge the wrongful act possibly committed.
Controversy
The hiring of country artists by city halls is at the center of the cultural debate in Brazil after singer Zé Neto, from the duo with Cristiano, criticized, during a show in Sorriso (MT), the artists who perform with funds from the Rouanet Law.
