MP questions structure used for involuntary hospitalizations in Cracolândia

The São Paulo Public Ministry will question the São Paulo City Hall about the structure used for the involuntary internment of 22 drug addicts in the Cracolândia region since April.

On May 13, the MP opened a Civil Inquiry to investigate “the regularity of the interventions carried out by the São Paulo City Hall in the region called Cracolândia, as well as the actions that followed the police interventions and that concern the complex problem derived from the consumption of crack cocaine”. and other drugs in scenes of collective use in the central region of the city of São Paulo”.

The investigation, however, is stalled after the City Hall appeals. The Superior Council of the MP can today analyze the request of the City Hall and judge the resumption or archiving of the investigation.

According to prosecutor Arthur Pinto Filho, from the Human Rights and Public Health sector, the Prosecutor’s Office wants to know the structure created to treat drug addicts hospitalized against their will so that the person does not return to abusive drug use or to the streets.

Filho explains that involuntary hospitalization has been allowed since, in 2019, President Jair Bolsonaro sanctioned the new Drug Law, which authorizes hospitalization without the consent of users.

Hospitalization must be authorized by a health agent and must last a maximum of 90 days, which is insufficient time to treat the addiction. “It’s just for detoxification,” says the promoter.

According to him, there is information from the City Hall that 22 people have already been involuntarily hospitalized. The MP did not confirm and, on the contrary, received information that these people were admitted voluntarily. 12 of the inmates had already left the clinics.

What the MP questions is whether the City Hall has set up a structure to insert these citizens back into their social circle, providing opportunities for housing, work and income, which is what the law requires.

According to Filho, these dependents spend 90 days or less in the hospital, and when they leave, they do not have any assistance. “They don’t even have the money for the pass to go back anywhere. Where do you think he’s going? Go to the only place you know, Cracolândia”, he says. “In other words, it’s public money being thrown away.”
