MP-RJ takes action so that Enel immediately restores electricity under a fine of R$50,000 for each injured consumer

The Public Prosecutor’s Office for Collective Protection of Consumer and Taxpayer Defense of the Núcleo Niterói filed, this Tuesday (21), with a Public Civil Action with Urgent Protection so that the electric energy concessionaire Enel immediately restores the electricity at residents of the municipality of Niterói, under penalty of a fine of R$50,000 for each injured consumer.

On Saturday (18), the city faced heavy rain, affecting several neighborhoods with a lack of electricity.

The action reports that warnings were issued by the municipal Civil Defense, through the Monitoring and Operations Center, informing Enel that there would be climate change in the city due to the passage of a cold front through the ocean, generating gusts of strong winds and rain showers. strong with lightning.

“What we saw were not typhoons, hurricanes, tornadoes or cyclones, just rain and strong winds resulting from climate change, from strong heat to a cold front passing through the ocean, as always occurs in our tropical climate. As is public knowledge, the electrical network is aerial, therefore, strong winds, unpruned trees and poorly maintained, obsolete equipment cause transformers to burst and consequent power outages, which has been recurring”, details one of the sections of the ACP.

The MPRJ also requests the Judiciary that Enel increase the number of emergency response teams, present a contingency plan within 15 working days, for the summer period, and carry out maintenance on the municipality’s transformers. And tree pruning to avoid frequent power outages in case of gusty winds.

The action asks the concessionaire to pay a fine for collective moral damages and present a list of all protocols opened on 11/18, with the respective closing and service date.

According to the MPRJ note, “the Public Prosecutor’s Office also monitors Enel’s CPI, installed in March this year by the Niterói City Council to investigate the concessionaire’s failures that result in interruptions in the supply of electricity. There are ongoing investigations that require forecasting the replacement of poles and installation of transformers, among other aspects of the service”.

The electricity concessionaire Enel RJ informed CNN that “it has not yet been notified about the aforementioned action”.
