MP-SP appeals the decision that released the father of a girl rescued with malnutrition

The Public Ministry of São Paulo appealed against the decision that released the father of the three-year-old girl rescued with malnutrition in Rio Claro, in the interior of São Paulo.

the promoter Cassio Sartori understood the case as an attempted murder, as the prisoner, whose identity has not been revealed, had a duty to feed his daughter and, consequently, avoid the resulting death.

Still according to the prosecutor, the situation in which the child arrived was not caused by lack of money, since the inventory of assets left by the mother of the accused indicates that he had goods and financial resources to feed his daughter.

According to the MP, the accused admitted that the intention was that both he and his daughter would starve to death.

In the appeal presented to Justice, Sartori asked for the preventive detention of the accused and cites actions in progress in the Family Court, which point out that the father prevented approximations between the girl and the maternal grandmother. This, in turn, sought him out frequently to help financially and with food.

The man was arrested in the act, after the Municipal Guard of Rio Claro and the Guardian Council of the municipality received a complaint of mistreatment and went to the condominium where he lived with the child. After going through a custody hearing, last Saturday (02), the father was released.

The girl was found malnourished and dehydrated. She would have gone 40 days without eating. The child received the first care at a UPA (Emergency Care Unit) in the city and, subsequently, was sent to Santa Casa de Rio Claro, straight to the ICU.

According to the doctor Sâmila Batelochi Galo who takes care of the girl, the child arrived at the health unit very weak, weighing 8 kilos, when the minimum weight for her age is 15 kilos.

In a note, the hospital reported that the patient has already gained two kilos and left the Intensive Care Unit (ICU) and is in the pediatric ward.

A multidisciplinary team, made up of a pediatrician, nutritionist, speech therapist, physiotherapist and psychologist, monitor the recovery of the child, who is receiving a special diet, with soft food, to recover. She also receives isotonic serum for hydration.

However, there is still no prediction of discharge. The child needs to gain at least another five kilos to reach the average weight of a child their age.

The girl’s maternal grandmother is in the hospital accompanying the recovery and must ask for custody of the child. She said that the girl’s mother died when she was a month old and her father had been in prison since the beginning of the pandemic.
