The Federal Public Ministry (MPF-SC) launched an investigation to investigate the performance of the Polydoro Ernani de São Thiago University Hospital, of the Federal University of Santa Catarina (UFSC), in the case of the 11-year-old girl, a victim of rape, who had a legal abortion. denied by the institution.
This Wednesday (22), a recommendation was issued to the superintendent of the hospital, Joanita Angela Gonzaga Del Moral, “to guarantee patients who seek the health service to carry out procedures for the termination of pregnancy in the event of legal abortion, the be performed by a physician, regardless of gestational age and fetal weight”.
The University Hospital (HU) of UFSC is registered with the Ministry of Health as a reference for legal termination of pregnancy.
According to the MPF, “legal abortion does not require any judicial authorization or police communication, and there are no limits in the legislation related to gestational age and fetal weight for carrying out the procedure”.
Attorney General Daniele Cardoso Escobar also determined that the HU should express its opinion on the MPF’s guidance until Thursday (23), at noon. “Exceptionally, due to the urgency that the case requires, a fixed deadline until tomorrow, June 23, at 12 pm, for information on the compliance with this Recommendation to be sent to this Attorney’s Office”.
The MPF will not comment on the specific case of the 11-year-old girl who was raped, due to the applicable secrecy of justice, “but it will adopt all appropriate measures to ensure compliance with the applicable legislation, protecting the rights of any person who experience the situation provided for by the norm, in this case, the chances of legal abortion”, said the organ.
