MPSP launches inquiry against City Hall for involuntary hospitalizations in Cracolândia

The Public Ministry of São Paulo opened this Tuesday (14) a civil investigation against the City of São Paulo for the involuntary internment of 22 drug addicts in the Cracolândia region, which had been taking place since April.

According to the promoter of Human Rights and Public Health, Arthur Pinto Filho, the hospitalizations are illegal, since the City Hall did not communicate them to the MPSP.

According to the Drug Law (Law 11,343/2006), the health unit that receives patients must inform the MP, the Public Defender’s Office and other inspection bodies about hospitalizations within 72 hours – a procedure that was not followed, according to Son.

The prosecutor defined that, at first, an inquiry will be opened for collective material damage. However, it may be expanded to seek liability for personal injury to inmates, as investigations progress.

The MP will still seek to hear the dependents, but has not yet been able to identify them, due to the lack of notification from the City Hall.

In a note, the Municipal Health Department of São Paulo (SMS) reported that the MP’s requirements to carry out the records of hospitalized patients are being forwarded, and that the data will be provided at the end of the process.
