New audience with Gugu Liberato’s daughters takes place today; understand inheritance dispute

This Thursday (22) there will be a new audience, starting at 9am, at the João Mendes Forum, in São Paulo, with the daughters of presenter Gugu Liberato on the presenter’s inheritance process and which analyzes his stable union between Rose Miriam.

At the hearing on Wednesday (21) a court official was at the hearings to notify the parties that a man was also said to be Gugu’s son. Trader Ricardo Rocha, 48 years old, claims to be Gugu’s son and asks, in an action that is being processed under secrecy of Justice, that the brothers undergo a DNA test to confirm the thesis.

Lawyer Nelson Wilians, who represents the twins Marina and Sofia, 20 years old, told the CNN who is still finding out about the paternity investigation action, but, in principle, “there is no reason for his clients to refuse to cooperate with a request for a DNA test, if it is pertinent under the law”.

Currently, the presenter’s recognized heirs are the twins and João Augusto, 21 years old. But, according to the twins’ lawyer, if Gugu’s new paternity is proven, the case will have a turnaround.

“If paternity is proven, that invalidates the will,” Wilians said.

On Tuesday (26), the 3rd Panel of the Superior Court of Justice (STJ) decided to reverse the decision of the São Paulo Court of Justice (TJ-SP), which reduced Gugu Liberato’s testamentary disposition. With that, the presenter’s desire to leave 75% of his assets to his children and 25% to his nephews came into force.

With that, Rose Miriam Di Matteo would not be recognized as one of the heirs. She filed a special appeal with the STJ.

The first testimonies took place in May, with the hearing of the twins Marina and Sofia, 19 years old, and other witnesses involved in the process. The two positioned themselves in favor of the mother.

According to Rose Miriam’s lawyer, there are elements that prove that she and Gugu maintained a public relationship.

“The twins Marina and Sofia have always been by their mother’s side in her search for recognition of a stable union in court. All elements prove that Rose and Gugu maintained a public, notorious, lasting, continuous relationship with the aim of starting a family. We reaffirm our belief that, every day, we are closer to seeing justice done”, said the lawyer, in a note.

Presenter Gugu Liberato died at age 60, in November 2019, the victim of an accident at home, in the United States. He fell and hit his head.

In the will, Gugu left 75% of the assets, estimated at R$ 1 billion, to his three children and the remaining 25% to his five nephews. The presenter’s sister, Aparecida Liberato, was defined as executor in case of the presenter’s death.

Since the presenter’s death, Rose has filed a lawsuit to recognize the stable union with Gugu. The Liberato family claims that he left a mansion and a sum of money to the mother of the three heirs. She denies having received it.

If Justice recognizes the stable union, Rose Miriam will be entitled to half of Gugu’s inheritance. The other 50% would be split between the couple’s three children.
