The Ministry of Justice presented President Luiz Inácio Lula da Silva (PT) this Wednesday (24) with the draft of the decree to regulate the use of weapons in Brazil. The initial text foresees that the Federal Police will inherit competences that belong to the Brazilian Army.
A CNN found that one of the sections on granting and authorization for collectors, shooters and hunters, the CACs, is assigned by the Army.
According to the text, the PF should be responsible for granting registration and authorization for the acquisition of weapons by the CACs. The proposal also removes the Army’s competence to supervise shooting clubs and transfers the function to the Federal Police.
The points were raised after the publication of decree 11.366, at the beginning of the year, which established a working group to present a proposal for new regulations.
The working group was coordinated by the national secretary of Public Security, Tadeu Alencar, with the participation of other interested bodies, such as the Federal Police, the Ministry of Defense, the Ministry of Finance, the National Council of Justice, the National Council of the Public Ministry, the Attorney General’s Union and non-profit institutions working on the subject.

The new decree should also change the number of guns per inhabitant. The current rule calls for a limit of 60 guns for sport shooters. Of the total, there are 30 firearms for permitted use, and 30 for restricted use.
As for hunters, the current rule allows for the possession of 30 weapons, 15 of which are permitted and another 15 are restricted.
The new proposal wants to reduce these limits, in addition to dividing shooters into tiers. For example, level 1 sport shooters will have access to up to 4 permitted firearms; level 2 sports shooter will have access to up to 8 permitted firearms; and level 3 sport shooter with up to 16 permitted firearms.
The text presented to Lula must still undergo changes. The president will evaluate the proposals with the government team to decide how to implement them. There is no deadline for the definition.
