New rules for welcoming people from the LGBTQIA+ community are already in force and were approved by the National Council for the Rights of LGBTQIA+ People and the National Council for Criminal and Penitentiary Policy.
With the changes, inmates will be able to use their social name and will have basic rights such as work, education and religious assistance guaranteed. All through self-declaration, that is, it is not necessary to present documents or undergo sexual reassignment surgery to prove sexuality or gender identity.
Transsexuals and transvestites can choose between the male or female wing of the prison. This can happen at any time during the legal process and the detainee has the right to change their mind. The person's choice will be included in the judge's decision or sentence.
In specific situations, such as when places reserved for LGBTQIA+ people are full or during riots, these people can be temporarily relocated, as long as safety and their rights are guaranteed.
The resolution also guarantees that LGBTQIA+ people in prison have the right to intimate visits in the same way as cisgender and heterosexual inmates. The changes were designed based on constitutional principles and international human rights treaties.
