Their lawyers described it as not serious Virvana the lawsuit of 30-year-old Spencer Elden, who appears as a baby swimming naked on the album cover Nevermind and who accuses the band of child pornography.
Lawyers working for Nirvana are seeking to drop the lawsuit against the band, according to the Guardian.
In a lawsuit filed in August, Elden claimed he had been sexually abused by children and that the cover was an image sexual abuse children. “The defendants knowingly produced, possessed and advertised commercial child pornography depicting Spencer,” the lawsuit read.
They are trying to disprove through their lawyers the 52-year-old drummer-guitarist Dave Grohl, the 56-year-old bassist Krist Novoselic, the Courtney Love – wife and heir of Nirvana leader Curt Coblain – and the photographer Goffy Kirk.
Elden’s claim that the image is of child sexual abuse is described by lawyers as “not serious. “A brief look at the photo or the behavior of Elden himself (not to mention the presence of the photo in the homes of millions of Americans who, according to Elden’s theory, are guilty of child pornography) makes this clear.”
“Beneficial for three decades”
Nirvana lawyers have argued that Elden “has spent three decades enjoying his fame as ‘Nirvana Baby,'” including recreating the image for the album’s 15th and 25th anniversaries.
They refer to the fact that Elden has a tattoo with the word Nevermind on his chest, which was also mentioned by Dave Grohl when asked about the lawsuit in October: “He has a Nevermind tattoo. I feel the same way most people do, as I have to disagree [με τους ισχυρισμούς του Έλντεν]».
