OAB-RJ commission members announce collective resignation after attempt to reopen police investigations

Around 150 members of the Human Rights Commission of the Brazilian Bar Association of Rio de Janeiro (OAB-RJ) filed a collective resignation, this Tuesday (9), following the dismissal of the then president of the commission, Ítalo Pires Aguiar.

According to members of the institution, the presidency of the Order began to suffer internal pressure after the CNN reveal that the commission intended to request the reopening of police investigations, because of allegations of corruption involving the former head of the state's Civil Police, Rivaldo Barbosa, identified as one of the people who planned the death of councilor Marielle Franco.

“Unfortunately, after the Human Rights Commission announced that it would investigate the investigations that were not completed by the police, the Presidency of the Order decided to dismiss the entire command on the grounds that it was under a lot of pressure, a lot of embarrassment and wanted the commission to act otherwise. In the report, Quintão had explained that, since the revelations of the Federal Police report about the possible interference of police chief Rivaldo Barbosa to hinder the investigations into the death of the councilwoman and her driver, Anderson Gomes, many lawyers approached the Rights Commission Human Resources (CDH) asking for support for the reopening of other cases in which there were suspicions of targeted filings, without a full investigation having actually been carried out. Therefore, a survey was being carried out of investigations that could present problems in the investigation due to some negligence on the part of the police.

Chief Barbosa was arrested by the Federal Police on March 24, accused not only of helping to plan the councilwoman's death but also of preventing investigations from reaching the real masterminds of the crime, the Brazão brothers.

“We came to identify four cases that would require a request for reopening. Two of these cases were sponsored by the Human Rights Commission itself. And the other two were from people who approached the Commission asking for help. We don't yet know how these cases will turn out. In the name of the Order, we can no longer carry out any type of procedure. But we are talking to people to find out if they want help to personally deal with these cases outside the Order”, revealed Quintão, this Wednesday (10).

Wanted by CNN the president of OAB-RJ, Luciano Bandeira, stated that the lawyers' resignation was for political reasons, since the Order will have elections in November.

“The dismissal of positions occurred in several committees and not just the Human Rights committee. There were dismissals from the Prerogatives Commission, OAB Jovem and several others. The resignation of people who make up a political group that presided over the CDH is natural”, said the president.

In a statement, the Order informed that the new president of the CDH will deal with cases of suspected negligence by the police that have been raised. According to Bandeira, José Agripino sent letters to the Public Ministry of Rio de Janeiro, the Secretary of Public Security and the Secretary of Civil Police, asking for information about the related investigations.
