The expert report from the General Institute of Forensics (IGP) of Rio Grande do Sul, sent this Wednesday (8) to the 2nd Police Station of Porto Alegre (RS), failed to identify in the speech of player Rafael Ramos, from Corinthians, movements compatible with the word “monkey” during a match against Internacional, held on May 14 for the Brazilian Championship.
At the time, midfielder Edenilson, from the club from Rio Grande do Sul, accused Portuguese side Rafael Ramos, from the São Paulo team, of racial slur. After the duel, he testified to civil police officers who went to the stadium’s locker rooms to investigate the case. According to Edenilson, Ramos would have called him a “monkey” after a ball dispute.
Four videos were sent for analysis, one being selected “because it presents a greater extension of the questioned scene and better signal quality”. The images were processed by enhancement software and 41 frames were extracted.
“It is technically unfeasible to locate all traces that define the sequence of consonants and vowels emitted. Most of the gestures that make up speech occur precisely in the intraoral environment or in other internal portions, such as the pharynx and larynx”, explains the expert.
“Not even in videos with excellent image quality it is possible to obtain information about what is happening in the non-visible part of the vocal tract”, he continues.
The agency clarifies that it was not possible to find scientific methodology, applied to the forensic analysis of videos for lip reading. The records sent also do not have the sound of the speeches that were of interest to the investigation, which made the audio expertise impossible.
“For these reasons, it is inappropriate for the State’s official criminal expertise to state, with responsibility from a procedural and scientific point of view, what was said by the player in the questioned scene.
wanted by CNN , Internacional reported that “it keeps monitoring the case involving Edenilson, giving support to the athlete. The process follows its normal course in criminal and sports justice. The Club awaits developments.”
After the report was published, Edenílson deleted all the photos from his Instagram account and changed his name to “Macaco Edenilson Andrade dos Santos”.
And he wrote: “Wouldn’t they shut us up? We’ve been silenced. If offended, accept, swallow dry. Pretend you didn’t hear it, it’s an unfair fight, it’s an inconclusive fight.”
Other reports
Two reports hired by the defense of Rafael Ramos concluded that the athlete did not pronounce the word “monkey”.
The first, released on May 20, concluded that Ramos said “hey man*** [palavra de baixo calão]”.
The second, published on June 3, pointed out that the Corinthians fan would have said “f*** yourself bro dude*** [palavras de baixo calão]”.
understand the case
Defending the leadership of the Brazilian Championship, Corinthians went to Porto Alegre to face Internacional on May 14. During the match, Edenilson told the referee that right-back Rafael Ramos would have called him a “monkey”. The match was stopped for a few minutes and then resumed.
Edenilson filed a complaint against Ramos with Civil Police agents, who went to the locker room to find out what happened to the player. In a post on social media, the athlete from the gaucho team pointed out that he “knows what he heard”, reiterated that he suffered the cursing and repudiated the alleged act of his professional companion.
In a statement, Internacional confirmed that Edenilson reported having suffered racial abuse by Ramos. The statement adds that “it is unacceptable that facts of this type still occur in 2022, there is no room for racism in our society”.
“The People’s Club reiterates that it repudiates any act of prejudice and supports its athlete”, concludes the text.
Corinthians only spoke officially in the early hours of Sunday (15), informing that Ramos denied that he uttered the curse and that the athlete went to look for Edenilson in the locker room, after the match, to explain himself.
According to the São Paulo club, “due to the complaint made by the Colorado athlete, the law requires that the case be treated as flagrant, followed by detention. The payment of bail does not imply admission of guilt, allowing the athlete to defend himself in freedom in the investigation”.
Corinthians ends by pointing out that both the club and the athlete will be available to the authorities.
Ramos spoke out, claiming that “I have not been, I am not, and I will never be a racist”. “I went to explain myself to my professional colleague, I have always followed a correct posture throughout my career, and it would not be otherwise now”.
Record racism in football
With nine cases of racial slur, six in Libertadores and three in Copa Sudamericana, and in all episodes of discrimination, Brazilian fans were targeted, Conmebol decided on May 9 to toughen sanctions in all competitions. of the entity, against acts of discrimination that occur “for reasons of skin color, race, sex or sexual orientation, ethnicity, language, creed or origin”.
By amending the measures provided for in article 17 of its Disciplinary Code, Conmebol increased the minimum fine against these acts from US$30,000 to US$100,000. From the changes, the judicial body responsible for a case can still determine that the punished club plays one or more games without fans, or until it has to close its stadium for matches.
In April alone, five cases of racism were recorded in games valid for Libertadores, in games for Flamengo, Corinthians, Bragantino, Palmeiras and Fortaleza. The last occurrence, on May 17, took place moments before the match between Corinthians and Boca Juniors and involved a supporter of the Argentine team who made racist gestures towards Brazilians.
Of the nine cases, so far Conmebol has opened seven investigations to investigate the allegations. In three of them, the suspicion of racial slur was proven and the clubs were fined. The most recent sentence was given against Emelec, in the amount of US$ 30 thousand (about R$ 150 thousand). The entity’s decision, on the 18th of last month, judged records of a match where an Emelec fan was filmed calling Palmeiras “monkeys” and laughing with other fans.
At the end of April, it was the turn of the confederation to fine the Argentine team River Plate, also in US$ 30 thousand. A fan of the club threw a banana in the direction of the Fortaleza fans during a Libertadores match.
What is racial slur
Racial injury is a crime provided for in the Penal Code and establishes a punishment of 1 to 3 years of imprisonment and a fine for anyone who offends the dignity of another person using elements relating to race, color, ethnicity, religion, among others. Thus consisting of an attack on honor or image and violation of constitutional rights.
Unlike the crime of racism, provided for in Law 7,716/1989, which occurs when the person of the aggressor affects a group or collective of people, discriminating against an ethnicity in general.
