The Ministry of Digital Development, Telecommunications and Mass Media of the Russian Federation (Mintsifry of Russia) has come up with an interesting initiative. According to the press service, the agency proposes to introduce a moratorium on administrative responsibility for the sale of smartphones, tablets, computers, laptops and smart TVs that do not have domestic software preinstalled.
As explained in the press release, due to the suspension of the activities of some foreign companies, the Russian government allowed the parallel import of goods. Parallel import is the supply of goods to the country not directly from the manufacturer and without the consent of the copyright holder. At the same time, Russian legislation requires manufacturers to pre-install domestic software. If the software is not preinstalled, the manufacturer and seller should be fined. Given the permission for parallel imports, there is a legal conflict.
To resolve this conflict, the Ministry of Digital Development proposes to introduce a moratorium that will free sellers from fines. The Ministry has already prepared a corresponding proposal for amending the Code of Administrative Offenses of the Russian Federation. The changes will not affect equipment manufacturers – they will retain the obligation to pre-install the software.
Recall that domestic software is preinstalled on devices from April 1, 2021. The pre-installation list is approved annually based on a selection of applications submitted by software copyright holders.
