On the day of the abolition of slavery, black movement sues state for racism

The black movement, Educafro, filed a civil suit this Friday (13), in which it asks the Union to condemn for acts and omissions that contribute to racism against the black population in Brazil.

The request was presented at the 5th Federal Civil Court of São Paulo on the same day that the abolition of slavery completes 134 years.

“I have just filed our public civil action asking for reparation for racism, for the effects of racism arising from slavery to this day. We are suing the Brazilian state for the racism that has existed since slavery,” said the group’s lawyer and prosecutor, Irapuã Santanna.

In case of conviction, the Union would be obliged to formally recognize the damage caused to the black population, due to racism; would have to offer an apology; and, thirdly, it should create a fund to combat racism and emancipation of the black population, free from contingency.

The action accuses the Union of committing an illicit act by promoting the resulting marginalization of the black population. He cites as an example the “historical construction of more than 350 years of enslavement of black people”, the “abolition of slavery in which there was no public policy aimed at the inclusion and emancipation of the recently “freed” black population, the elaboration of legislation “throughout the of the years that accentuated the marginalization of black people” and, finally, mentions the “manifest omission of the State to provide spaces and tools for social mobility and guarantee the basic rights of the black population”.

The Union still needs to manifest itself in court.
