The Union has the autonomy to request or not the vaccination passport for tourists entering the country. However, within the territory, states and municipalities can control circulation and request the document to allow people to enter events or frequent public spaces.
“At ports and airports, the competence is exclusive to the Union, but after entering the country, within their respective territories, the states and municipalities have concurrent competence to establish or not the need for a vaccine passport”, says Murilo Rezende, professor of Constitutional Law of Mackenzie University.
The federal government published, this Thursday (9), an ordinance that requires a quarantine of five days and testing for those who arrive in the country, but rejected the tip from Anvisa to require a passport.
Rezende emphasizes that the STF expressed its competence for the protection of health in the national territory and signed a decision on competition between the Union, states and municipalities in relation to the subject.
“In practice, once people have entered the country, if states and municipalities require a vaccination passport and the tourist does not have it, he will not be able to enjoy his trip. He will not be able to enter restaurants, bars, events”, he explains.
On the government’s assertion that the passport requirement would limit individual freedom, the professor disagrees and says that the defense of life overlaps in sensitive cases such as those related to a pandemic. “It seems to me that, due to the context we live in, life must prevail, and in this situation there is social, collective interest”, he adds.
