The former CEO of Americanas Miguel Gutierrez has lived in Madrid, Spain, for over a year. Former director Anna Christina Ramos Saicali is in Portugal. The two are considered fugitives and their names were included on Interpol’s wanted list.
For the arrests to be carried out, the Federal Police (PF) will need support from the police in European countries. According to PF sources interviewed by CNN , the case of the former CEO could be complex. This is because Miguel Gutierrez would have Spanish citizenship. According to legislation, Spaniards cannot be extradited.
Miguel Gutierrez and Anna Christina Ramos Saicali are identified as members of one of the biggest frauds in the history of the Brazilian financial market. The amounts involved are around R$25.3 billion. This Thursday’s operation (27) was monitored by the Securities and Exchange Commission (CVM).
Among the crimes investigated in the investigation are: market manipulation, use of privileged information, criminal association and money laundering. If convicted, the penalties for the retailer’s former executives could reach 26 years in prison.
When contacted, Miguel Gutierrez’s defense informed that they are waiting to have access to the decision before making any comments. A CNN has not yet been able to contact Anna Christina Ramos Saicali’s lawyers.
In a statement, Americanas informs that it trusts the authorities investigating the case and places itself as a victim of the financial fraud operated by the former board.
“Americanas believes in Justice and awaits the conclusion of the investigations to hold everyone involved legally responsible”, completes the statement.
