Tomorrow, February 15, the obligation to have a reinforced green pass for workers in the public and private sectors (even if self-employed) for the over 50s who, therefore, must have undergone two doses of vaccine, or one dose and be healed. Certification will be essential to access the workplace, whether it is the office, the company, the shop: those who do not have it risk suspension from office and salary. The obligation of the reinforced green pass for all workers over 50 will remain in force until June 15th 2022.
Workers who do not have one are considered unjustified absent, “without disciplinary consequences and with the right to retain the employment relationship”. For the days of unjustified absence «no salary or other compensation is due or emolument “.
There are penalties for those who are caught in the workplace without a reinforced green pass: this is the “payment of a sum from € 600 to € 1500 and the disciplinary consequences according to the respective sector regulations remain valid “. If, however, the violation is repeated, the sanction doubles. In case of omission, even the inspectors risk a fine, ranging from 400 to 1,000 euros.
The fine is 100 euros, and comes with the file from the Revenue Agency.
Obviously, there are exemptions: the vaccine obligation “does not exist in the event of an ascertained health hazard, in relation to specific documented clinical conditions, certified by the general practitioner of the assisted person or by the vaccinating doctor ». In these cases, which must be certified, vaccination “can be omitted or deferred”. The rule also establishes that, for the period in which vaccination is omitted or deferred, the worker can be assigned “to even different taskswithout curtailment of salary, in order to avoid the risk of spreading the infection from SARS-CoV-2 “.
Vaccination exemption certification is issued in digital formatto allow checks by scanning the QR code: those with a paper certificate have until February 27 to request the digital one, which is valid only in Italy and can be used to access where a green pass is required.
