Palmares Foundation asks STF to keep decision on Sérgio Camargo

The Palmares Foundation sent a request to the Federal Supreme Court to uphold the decision of Minister Gilmar Mendes who, in February, determined that it is up to the Federal Court to analyze a public civil action against the president of the body, Sérgio Camargo, for moral harassment against civil servants.

In February, the minister responded to a request from the Foundation and acknowledged that the process should not go through the Labor Courts. In March, the PGR (Attorney General’s Office) appealed the decision, stating that the case should be processed in the Labor Court.

According to the Foundation, in action on the subject, the STF ruled on the competence of the Labor Court to judge cases in which legal relationships in which the Public Power is involved are discussed.

“It should not be any employment relationship that, if it becomes litigious, is subject to the competence of the Labor Court. The case can only be processed in the Specialized Court in cases where a legal relationship constituted by an employment relationship is discussed. The investigations lasted a year and, according to the MPT-DF (Ministry of Labor), 16 people were heard, including former employees, public servants, commissioned and outsourced employees.
